Subway sues over user generated ads

This ought to be interesting. Quiznos created a contest for users to submit video ads showing its superiority to Subway. Then Subway sued, saying that some of the ads make false claims. But since Quiznos didn’t make the ads — just solicited them — should they be held liable? The outcome could have deep ramifications for not only user ads, but content as well.

Among Subway’s claims is that user videos were “derogatory” toward Subway. Why are they bothering a judge about that? Since when was there an “unless you’re not being nice” clause in the First Amendment? Same with their claim that a Quiznos-produced ad showed people on the street insulting Subway. So what? People are allowed to express negative opinions about anything, even on the highly sensitive and controversial subject of sandwiches.

subway ought to take a camera over to the island of molokai… you’ll find a subway on island, but no quiznos! no mcdonalds, burgerking, wendy’s, 7-11, walmart, victoria’s secret, sears OR just about any other publicly traded company (save 2 small chevrons).
quiznos has some catching up to do… so does the island of molokai.
