Why are they bothering a judge about that? Since when was there an "unless you're not being nice" clause in the First Amendment? Same with their claim that a Quiznos-produced ad showed people on the street insulting Subway. So what? People are allowed to express negative opinions about anything, even on the highly sensitive and controversial subject of sandwiches.
