Judge rules in favor of site sued for comments

It’s what many media folks are still worried about: what if someone posts a comment on our site that gets us sued? Well, a federal court has ruled that ConsumerAffairs.com can’t be held responsible for user comments that blasted car dealers. Very good news.

    This is unsurprising — the CDA and case history is pretty clear about this issue, and it’s been that way for a decade.

    While the safe harbor concepts are pretty well established, it’s still good news to see them get applied again.

    I suppose the real headline here could be: “Judge upholds laws as written and intended”

    someone said this here a few days ago, “sometimes the comments are better than the actual story”.

    a great example of this is the boulder daily camera (dailycameradotcom).

    not only is boulder a wild city, its citizenry has pretty good sense of humor.

    their comments are unmoderated and very few are flagged for deletion, lending itself to the idea that a community will self-police itself (like here!)

    Seems like a no-brainer, but so many ridiculous lawsuits go through these days, it’s good to hear that this isn’t one more thing to worry about.

    whoever is in charge of launching the $mart$avings vertical should know that’s a direct mail magazine in florida. logoing looks a bit too similar, too.

    launch first, research later. good strategy.

    btw- they have some slick promo videos on youtube.

    if someone over there can swallow their pride long enough to drop me a line, i’ll explain why ClickOnSavings is far more intuitive (and webby). also, how we’ll lend it to “you” for $1.
